Liability Waiver and Refund Policy

If payment is made to Scribble Art Workshop by VISA®, MASTERCARD® or DISCOVER®, the issuer of the card identified is authorized to pay the amount agreed upon. By agreeing to this text, we promise to pay such total subject to and in accordance with the agreement governing the use of such card.

I, individually or as parent and/or guardian of the minor child enrolling in a Scribble Art Workshop Class hereby acknowledge the following notices and grant to Scribble Art Workshop, the following release from liability:
 
A. LIABILITY: I acknowledge and fully understand that I/my child will be engaging in physical activities that may involve some risk of injury. I acknowledge and have been advised that it is my responsibility to consult with my/my child’s physician with respect to any past or present injury, illness, health problem or any other condition or medication that may affect my/my child’s participation. I assume the foregoing risks and accept full personal responsibility for any personal injuries sustained by myself/my child which might incur as a result of participating in this program and discharge and hold harmless Scribble Art Workshop, their owners, directors, members, employees and agents from any claim, cause of action or liability for damages arising from any personal injury to me/my child or other persons or property caused by my participation in the Scribble Art Workshop program.
 
B. PAYMENT: If you elect for the auto monthly payment plan, the first payment will be paid at time of class pass purchase. Subsequent payments are automatically deducted equally on a monthly basis until the conclusion of the class session. A payment plan is NOT a month-to-month registration but rather a convenience we afford to our clients.  If registration is cancelled at any time, we defer to our refund policy.  If you elect to pay in full, one full payment is deducted at time of class pass purchase. Failure to comply with the terms of this agreement will subject you to cancellation at anytime, including during this class. Scribble Art Workshop retains the right to charge 1.5% per month (equal to 18% per year) to all late payments.
 
C. REFUND POLICY: Full refunds will be given up to one week before the start of the program or if registration is cancelled by Scribble Art Workshop due to overbooking.  If you request a refund before the first day of class but after the one-week mark, Scribble Art Workshop will retain a $50 processing fee. ABSOLUTELY NO REFUNDS WILL BE GIVEN AFTER THE START OF THE CLASS. CREDITS WILL BE ISSUED AFTER THE FIRST WEEK OF CLASS AND CAN BE USED IN ANY OTHER AGE-APPROPRIATE SCRIBBLE ART WORKSHOP CLASS IN WHICH THERE IS SPACE WITHIN ONE YEAR OF ORIGINAL ENROLLMENT. AFTER THE FIRST WEEK OF CLASS, THERE ARE NO REFUNDS OR CREDITS. FOR FULL DAY, HALF DAY WORKSHOPS AND CAMPS, THERE ARE ABSOLUTELY NO REFUNDS. IF YOU GIVE US NOTICE OF 24 HOURS OR MORE OF CANCELLATION, WE CAN ISSUE YOU A CREDIT THAT CAN BE USED FOR ANOTHER WORKSHOP.We submit to the jurisdiction of the state of New York with respect to any disputes regarding this contract and/or Scribble Art Workshop. Further, if there is a dispute, then the prevailing party in the dispute shall be entitled to recover the costs and fees (including reasonable attorney fees) incurred in connection with the dispute. Cancellations must be submitted in writing to program directors or managers.  
 
D. STUDENT CONDUCT: Realizing that the orderly operation of Scribble Art Workshop programs is of the utmost importance. We agree to comply with all our rules, policies and regulations. We fully understand that Scribble Art Workshop reserves the right to cancel any student's enrollment if the student's physical or mental condition, as disclosed by personal questionnaire, medical, or dental certificate or otherwise, is deemed unsatisfactory, or to dismiss a student whose condition, conduct, influence or behavior is deemed unsatisfactory or detrimental to the best interests of Scribble Art Workshop. In such cases, the unused portion of Scribble Art Workshop fees will be refunded. No refund, however, will be made on a voluntary withdrawal or violation of Scribble Art Workshop policies. We agree to Hold Harmless and indemnify Scribble Art Workshop if our student damages property or injures or harms any individual. NO ALLOWANCE SHALL BE MADE FOR LATE ARRIVAL OR EARLY DEPARTURE.
 
E. PERSONAL BELONGINGS: In addition, we understand Scribble Art Workshop is not responsible and are held harmless for damage or loss of money, jewelry, equipment, clothing or other personal articles. DO NOT SEND VALUABLES TO SCRIBBLE ART WORKSHOP. We understand that valuable items are brought to Scribble Art Workshop at our own risk.
 
F. PHOTO RELEASE: I AGREE to give Scribble Art Workshop permission to use photographs, videos or audio recordings of myself or my child for any Scribble Art Workshop promotional materials. I understand that my child will not be identified by name, nor will any compensation be extended for such use.
 
G. MEDICAL: If it is necessary, in the judgment of Scribble Art Workshop Directors, to use outside medical, surgical, or dental aid for the student's health, we hereby permit and authorize him/her to do so.
 
APPLICABLE FOR ALL CLASSES, EXCEPT ADULT CLASSES:

H. EXHIBITION: One of the significant initiatives of our progressive art education organization is to exhibit our students’ work in a professional setting and sell it for the benefit of less fortunate students. I hereby agree to give permission to Scribble to exhibit and sell (with all proceeds sponsoring kids to take art classes for free) my child’s artwork. I understand that only one piece of artwork per class per year will be sold and all others will be returned to the artist.
 
I. MAKEUPS: Make up classes will only be available for toddler classes (mini-scribblers). Students can make up a maximum of one class per session by attending any other class that is age appropriate. Parent must email Scribble before the attendance of the make-up to ensure that there is space available.
 
J. DAYCARE CLAUSE: For students under the age of 6, New York State prohibits us from providing instruction (without parental supervision) for more than 5 hours per week, for more than 30 days in a 12-month period. I agree to be present for any time period that exceeds the 5-hour per week limit.
